A real estate business manager is being accused of embezzling approximately BRL 10 million accounts for 40 condominiums in São Paulo (SP). In a letter sent to the liquidators, a company partner blames the pandemic, “wrong choices” and reveals that he even tried loans with loan sharks to avoid coup.
The situation began to be noticed by the liquidators in the last two months, when the payment statements, which should be delivered by the administrator, began to be delayed and the partner did not respond to attempts to contact him.
Two weeks ago, the trustees of the condominiums managed by Fort House received a “message” via mail, instead of the statements. In the letter, signed by managing partner João Carlos Caporicci Prudente da Silva, he apologizes for the disappearance of the money and blames the pandemic and “wrong decisions” for the disappearance of the money (read the full text at the end of the article).
“Many things have happened, we have barely faced the Covid-19 pandemic, including being hospitalized right at the beginning of the pandemic (I was intubated in the ICU where I remained under intense care for almost 30 days), when I return I face troubled days with many physical limitations and mental health, in addition to not having realized the depressive state I was in, having taken many wrong decisions, which compromised the financial health of my company and unfortunately of some clients”, wrote the partner in a letter sent to the trustees.
As soon as he received the letter and realized that the condominium bills, which previously had about R$ 437,000, were now zeroed, the manager Ricardo Nascimento, from the Acquária Building, in Jabaquara, went to the Civil Police and filed a police report with 35th DP of the capital, which will monitor the case.
The Acquária building, which has 72 apartments, has been managed by Fort House since 2017 and, before that, had never had problems with the bills, according to the trustee.
To the Earththe lawyer Magna Silva, hired to represent the building in court, says that a survey carried out by the liquidators of buildings in the region, who know each other, points out that 40 buildings may have been damaged by the financial coup, resulting in a loss in the accounts that, added , would exceed R$ 10 million.
The lawyer says she is preparing a civil liability action accumulated with losses and damages to try to recover the amounts in court. According to her, the strategy is to try to reach the partner’s equity, before he disposes of goods and values while the process is ongoing.
She, who represents only one building, does not rule out the possibility of a class action against the company. “It wasn’t the path that Acquária wanted at the moment, but it could happen in the future”, she said.
Manager with years in the market
The Fort House company, headquartered in the Jabaquara neighborhood, in the south zone of São Paulo and, according to its website, has been on the market since 1993. However, in consultation with the Federal Revenue, it appears that the CNPJ was opened in 2012.
The company’s sole partner is João Carlos Caporicci Prudente da Silva. O Earth could not find it to get a placement.
Among the services offered to condominiums is account management and debt payments.
“The condominium will have its own bank account, which the trustee can access 24 hours a day. The monthly rendering of accounts is sent to the trustee, through the accounting folder, which will contain the bank statement of the condominium account, in addition to all the supporting documents of income and expenditure, facilitating the verification of receipts and checks issued”, says the official website of the company, which is still online.

Throughout my professional life, I have striven to seek the best for my clients, especially in the financial area, as it is my specialty and all decisions and investment choices have always been mine, being solely responsible for the financial handling of your condominium.
Many things have happened, we have barely faced the Covid-19 pandemic, including being hospitalized right at the beginning of the pandemic (I was intubated in the ICU where I remained under intense care for almost 30 days), when I return I face troubled days with many physical and mental limitations , in addition to not realizing the depressive state I was in, having made many wrong decisions, which compromised the financial health of my company and unfortunately that of some clients.
I am fully responsible for my mistakes with my clients and also with my employees, who were also directly affected by my wrong actions and decisions, the mismanagement of the accounts entrusted to me, and I feel deeply devastated by the situation I have put them in this time.
I’m sorry for all the harm I’m causing to the tenants, but the wrong decisions generated a major financial problem, which forced me to resort to loans with loan sharks and banks, with high interest rates, completely destroying any chance of me being able to pay off the debts . I also need to clarify that I didn’t acquire goods, I didn’t embezzle money and I didn’t get rich either, on the contrary, I’m completely bankrupt.
Along with this letter, I am delivering the bills that are due and that have not been paid.
There is no justification for my conduct, but I cannot further harm my customers and employees.

The assemblies that are scheduled unfortunately will not have our presence. The condominium quotas for the month of April/2023 will also not be issued, which is why they should immediately seek another administrator to perform this service.
