Public Prosecutor’s Office will set limits on the use of ChatGPT in lawsuits

The CNMP (National Council of the Public Prosecutor’s Office) should analyze in the coming weeks a proposal for a resolution to regulate the use of artificial intelligence tools, especially ChatGPT, by prosecutors and prosecutors in the production of legal documents. The proposal is being prepared by counselor Rodrigo Badaró.

The topic was taken to the CNMP by lawyer Fábio de Oliveira Ribeiro, who asked that clear rules be defined for the use of tools – which today are not authorized by the public administration. The main risk, according to the lawyer, is the sharing of sensitive information in foreign databases.

Badaró suggested that attorneys-general and inspector-general of the Public Prosecutor’s Office guide the members of the institution, servants and interns to observe the risks of indiscriminate use of the tools.

The proposed resolution will be based on technical manifestations produced by the Information Technology Secretariats of the Public Prosecutor’s Office on the risks of using artificial intelligence. The counselor also asked that three CNMP commissions be heard: on strategic planning, on fundamental rights and on preserving the autonomy of the Public Prosecutor’s Office.
